BabyGen.app offers AI-based baby face prediction services and related functionalities to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and using our services, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. The Service includes the generation of predicted baby faces based on parental images you provide (the “Predictions”) and any other services or features we may provide. This Agreement is entered into by BabyBlend.ai and you, the entity or person agreeing to these terms (“Customer”), and governs the Customer’s access to and use of the Services. This Agreement becomes effective when the Customer acknowledges acceptance and proceeds to use the Services (the “Effective Date”). We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Service Description and Use

BabyGen.app provides a unique AI-driven service that predicts the potential facial features of a future child based on the digital images of the parents submitted by the user. This service is intended for entertainment purposes only and should not be used for any medical, legal, or scientific purposes.

• Service Use: To use our service, users must upload clear, recent digital photographs of the child’s parents. The AI algorithm will analyze these images to generate a facial prediction of the potential child. The user will receive images representing both a boy and a girl as part of the prediction output.
• Nature of Predictions: The predictions are generated by AI algorithms and are speculative. They are not intended to be accurate representations of any future child. Users should understand that the technology is based on current AI capabilities, which have limitations and are subject to change.
• No Medical or Scientific Claims: The predictions made by BabyGen.app are not intended to be used for medical or genetic purposes. They do not provide any insight into the health, genetic traits, or any medical conditions of any potential future child.
• Service Modification and Availability: We continuously strive to improve our service and may modify the algorithms, features, or the user interface at any time without prior notice. While we aim for continuous availability, the service may be subject to downtimes and maintenance periods.
• User Responsibilities: Users are responsible for ensuring that the photographs they provide comply with our photo submission guidelines and do not infringe on any third-party rights. Users must also ensure that they have the necessary rights and permissions to use the images they upload.
• Age Limitation: Users must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

3. Intellectual Property Rights and User Content

• Intellectual Property of BabyBlend.ai: The technology, software, algorithms, methodologies, designs, and all other intellectual property related to BabyGen.app’s services, including all predictive images generated by our AI (collectively referred to as “Our IP”), are the exclusive property of BabyGen.app or its licensors. Use of Our IP is strictly limited to the scope of the services provided and does not transfer any intellectual property rights to the user.
• User Content: When you upload images or any other content (collectively, “User Content”) to our platform, you retain all rights to your User Content. However, by uploading User Content, you grant BabyGen.app a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display the User Content solely for the purpose of providing and improving our services.
• Responsibility for User Content: You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content you submit. You agree to not upload any content that infringes upon any intellectual property or personal rights of others.
• Prohibited Content: Users must not upload content that is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates any party’s intellectual property or these Terms of Service.
• Content Removal and Account Termination: BabyGen.app reserves the right, but is not obligated, to remove or refuse any content for any reason at our sole discretion. We do not use this data for any unrelated marketing or commercial purposes without explicit consent from the user.

• No Warranties: BabyGen.app expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Limitation of Liability: In no event shall BabyGen.app, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
• User Responsibility: You agree to defend, indemnify, and hold harmless BabyGen.app and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

6. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BabyBlend.ai operates, without regard to its conflict of law provisions.
• Dispute Resolution: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the jurisdiction in which BabyGen.app operates.
• Arbitration: If a dispute arises out of or relates to these Terms, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by a recognized alternative dispute resolution provider before resorting to arbitration.
